Terms of Service

ARTICLE 1: Purpose
These General Terms of Service (hereinafter "TOS") are intended to define the terms and conditions under which the Publisher provides users (hereinafter the "User") with the Tesla Dash mobile application (hereinafter the "Application"). By downloading, installing, or using the Application, the User unconditionally accepts these TOS.
ARTICLE 2: Legal Notice and Hosting
The Tesla Dash Application is published by: Florian RIFFLART, operating as a sole proprietor (auto-entrepreneur). SIRET Number: in the process of being registered. ARTICLE 3: Access to the Service and Prerequisites
To use the Application, the User must have:
- A compatible Tesla vehicle,
- An active Tesla account and the associated credentials/access tokens (tokens),
- A smartphone with Internet access.
The User is solely responsible for the security and confidentiality of their login credentials.
ARTICLE 4: Description of Services
Tesla Dash is a management and automation tool for Tesla vehicles. It notably enables:
- Remote command execution (lock/unlock, climate control, horn, etc.),
- Real-time data retrieval via telemetry (odometer, sentry mode, speed, interior temperature, battery state of charge, etc.),
- Creation of automations to trigger actions (commands or notifications) based on conditions predefined by the User (geolocation, battery level, time, etc.).
ARTICLE 5: Independence from Tesla, Inc.
The Tesla Dash Application is neither affiliated with, associated with, authorized by, endorsed by, nor approved by Tesla, Inc. or any of its subsidiaries. The Application uses Tesla's application programming interfaces (APIs) to function but constitutes an independent third-party product. The name "Tesla" is a registered trademark owned by Tesla, Inc.
ARTICLE 6: "As Is" Clause and Availability
The Service is provided "as is" and "according to availability," without any express or implied warranty. The Publisher does not guarantee any absolute result regarding the operation of the Application. The operation of the Application depends on external factors entirely beyond the Publisher's control, notably:
- The availability, stability, and modifications of the APIs provided by the manufacturer (Tesla, Inc.),
- The quality of the network connection of the User's smartphone and the vehicle's cellular connection,
- The proper functioning of third-party servers.
Consequently, the Publisher cannot be held liable for delays, command failures, inaccurate or outdated telemetry data, or the inability to execute an automation in the event of network, hardware, or manufacturer system modification failure.
ARTICLE 7: Extended Limitation of Liability (Damages and Automations)
The Application allows physical interaction with the vehicle (opening the trunk, doors, windows, etc.) remotely and in an automated manner. The User acknowledges being solely responsible for checking the vehicle's surroundings before executing any physical command (directly or via automation). The Publisher disclaims all liability in the event of collision, impact, material damage (to the bodywork, to infrastructure such as a garage ceiling, etc.), or bodily injury resulting from:
- A command executed manually by the User via the Application,
- An automation configured by the User, even if triggered at an inopportune or unforeseen time (for example, opening the trunk in a confined space upon arrival in a geographic area).
It is the User's responsibility to ensure that the automations they create present no risk to the vehicle, to others, or to surrounding property. The User assumes full responsibility for the consequences related to the use of vehicle control features.
ARTICLE 8: User Obligations
The User agrees to:
- Use the Application only for personal and lawful purposes,
- Not use the Application while driving or in any situation where it could compromise road safety,
- Not attempt to hack, modify, or alter the Application's code or its communications with third-party servers.
ARTICLE 9: Intellectual Property
The Application, its structure, design, source code, and content (excluding data from Tesla and third-party brands) are the exclusive property of the Publisher. Any reproduction, representation, or partial or total exploitation is strictly prohibited without express prior authorization.
ARTICLE 10: Telemetry Data and Third-Party Servers
The Application retrieves telemetry data from the vehicle to ensure its operation and trigger automations. This data is securely transmitted via a third-party server (Firebase Cloud Function) where it is processed before being transmitted to the User's device. The Publisher undertakes to process this data strictly within the scope of the Application's operation. Telemetry data is not resold to third parties. For more details on the processing of personal data, the User is invited to consult the Application's Privacy Policy.
ARTICLE 11: Modification of the TOS
The Publisher reserves the right to modify these TOS at any time, particularly to adapt to technical or legal developments. Users will be informed of these modifications through an update of the Application. Continued use of the Application after modification constitutes acceptance of the new TOS.
ARTICLE 12: Applicable Law and Competent Jurisdiction
These TOS are governed by French law. In the event of a dispute relating to the interpretation or execution of these TOS, and failing an amicable resolution, the French courts shall have exclusive jurisdiction, subject to any specific jurisdiction arising from a mandatory statutory provision (particularly in matters of consumer law).
